Le putschiste du 22 mars 2012, le capitaine Amadou Haya Sanogo, et ses compagnons d’armes auront à se crisper encore dans les tréfonds de leurs cellules. Et, pour cause, la Chambre d’accusation de la Cour d’appel de Bamako a, de nouveau, rejeté leur demande de leur mise en liberté provisoire.
Le mardi 10 juillet 2018, la Chambre d’accusation de la Cour d’appel de Bamako a statué sur l’affaire des auteurs des fosses communes de Diago contenant des corps des bérets rouges. C’est une affaire qui remonte aux années 2012-2013.
En substance, rappelons qu’à la suite de la mutinerie au camp Soundiata Kéita de Kati, qui s’est soldée par un coup d’Etat militaire, une junte, conduite par le capitaine Amadou Haya Sanogo, avait mis un coup de frein au jeune processus démocratique malien en destituant toutes les institutions de la République et instituant, en lieu et place, un Comité national pour le redressement de la démocratie et la restauration de l’Etat (CNRDRE).
L’Accord de Ouagadougou pour la sortie de crise, signée le 6 avril 2012, a constaté la démission du président Amadou Toumani Touré et pris acte de la désignation de Pr. Dioncounda Traoré, président de l’Assemblée nationale en qualité de président de la République. Du 30 avril au 1er mai 2012, le Régiment des commandos parachutistes a, à son tour, tenté un coup de force contre les membres du CNRDRE.
A la suite des violents affrontements qui s’en sont suivis entre frères d’armes, vingt-et-un “bérets rouges” ont été retrouvés plus tard ensevelis dans deux charniers situés à Diago, près de la ville de Kati. Ainsi, sur instruction du procureur général près la Cour d’appel de Bamako, le procureur de la République près le Tribunal de la première instance de la Commune III de Bamako a ouvert une enquête ayant abouti à l’information judiciaire et l’inculpation de 28 militaires dont le capitaine Amadou Haya Sanogo pour enlèvement de personnes, assassinat et complicité. A cet effet, une ordonnance de transmission des pièces au procureur général est intervenue le 10 février 2015.
C’est ainsi que des infractions ont été retenues à l’encontre des accusés, tous, depuis, sous mandat de dépôt à l’exception d’Ibrahima Dahirou Dembélé, Mohamed Issa Ouédraogo et Ibrahima Boua Koné, et sont réprimées par les dispositions des articles 199, 200, 240, 24 et 25 du code pénal. Sur les réquisitions, le procureur général près la Cour d’appel en date du 23 juillet 2015, la Chambre d’accusation de la Cour d’appel de Bamako, par son arrêt n°585 du 22 décembre 2015, a ordonné un non-lieu à suivre à l’égard de 8 personnes et mis en accusations 18 personnes (dont un décès) renvoyées devant la Cour d’assises.
Vu les interprétations tendancieuses, l’affaire n’a pas marché. Le mardi 10 juillet 2018, la Chambre d’accusation de la Cour d’appel de Bamako a encore inscrit l’affaire à son rôle, à la suite de la demande de mise en liberté provisoire sollicitée par la défense. Étaient présents à l’audience comme avocats des accusés Me Tiéssolo Konaré, Me Mariam Diawara, Me Issa Coulibaly et Me Hamidou Dembélé.
Par ailleurs, selon une source proche du dossier, à l’issue de la reprise du procès, certains des accusés vont bénéficier de la liberté provisoire. Mais, elle a rejeté la demande de mise en liberté provisoire du général Amadou Haya et compères. Ce dernier et ses codétenus doivent encore s’impatienter au fond de leurs cellules, car la loi est au-dessus de tous, qu’on soit civil ou militaire.

IBK after accepting Comrade Sanogo turning over government of Mali to interim authority that held election that allowed IBK to be voted as president cleverly betrayed Comrade Sanogo plus his men arranging for them to be arrested plus still hold them in custody without trial. IBK did all of this to satisfy those foreigners who theft of Malian riches were cutoff due to Comrade Sanogo plus his men successful revolution. IBK is rumored to have resumed allowing those thefts with IBK taking place of ATT. This is cause Comrade Sanogo plus his men have been held in custody for years without trial with all knowing under what is acceptable acts of war they are innocent of all charges.
Well once again IBK government in using entity of government. It is judiciary of Mali. IBK have proven that IBK have no regard for first rule of being good leader in developing nation. That rule is to treat all law abiding citizens of Mali as IBK treat members of IBK family of same condition. If IBK had given Comrade Sanogo plus his men same treatment IBK give IBK family members in similar conditions there would be no trial plus Comrade Sanogo plus his men would be free. This is another condition that clearly demonstrate IBK is not fit to be president of Mali. A good president for sake of not further dividing nation would have bought closure to this condition instead IBK satisfy foreigners desire by punishing Ubuntu(Comrade Sanogo plus his men) who cut foreigners thefts of taking riches from Ubuntu of Mali.
Mali need Moussa Coulibaly as its president.

I experienced much same cowardice plus incompetence with Mandela in South Africa. It led me to charge Mandela with being sellout. Although Mandela made changes in South Africa he did not make enough changes for benefit of Ubuntu people plus it was well within his power to make those additional changes.
